Page for page, a Durable Power of Attorney may be the most import little legal document you can have prepared. A power of attorney allows one person to act on behalf of another person, usually if the second person is temporarily or permanently incapacitated.

What happens if I have not given someone Power of Attorney?

Without a power of attorney in place, even the spouse of an incapacitated person may have to go to court to be named the guardian of that person in order to conduct business on that person’s behalf.

What else should I have in place in addition to a Durable Power of Attorney?

You should have a Will or a Guardianship and Trust if you have minor childern.  You should also have a Revocable Living Trust in order to keep your estate out of probate.  Our revocable living trust package includes a Revocable Living Trust, Power of Attorney, Living Will and a Pourover Will.
